Terms & Conditions

www.diamonddiving.net is Diamond Diving’s (scuba diving centre) website.

Based in Golfe Juan we offer a number of activities related to leisure scuba diving. (training, diving, equipment sales and equipment servicing).

1.Scope of application

These terms and conditions are relevant to all transactions between Diamond Diving and its clients.  Clients may download a copy from our website www.diamonddiving.net.

2.Accepting the general terms and conditions

By using a service proposed by Diamond Diving a client accepts these general terms and conditions.  They also declare they understand the risk factors associated with scuba diving and that they are physically fit to practice the activity.  A student under the age of 18 must possess a written parental authorisation allowing them to undergo a diving or first aid course with Diamond Diving.

3.Prices

All of the prices on the website are in Euros and expressed as inclusive of all taxes (TTC).  They relate to the services we offer in the domain of leisure scuba diving, equipment rental, equipment sales and include all associated costs and taxes.
Prices indicated our website and other documents have no contractual value and will be confirmed upon finalisation of a booking.

Diamond Diving reserves the right to amend prices at any moment.

4.Inscriptions – Bookings

The client confirms that they have read and understood the description of their chosen product, the general terms and conditions and all other relevant information.  They confirm that they understand and accept these conditions without exception.

Reserving a training course or a fun dive implies:

  • Paying a deposit of a minimum of 30% of the total amount (50% for local clients and courses). The deposit in non-refundable.
  • Dive card packs can be shared between friends and family on the condition that two or more come at the same time each instance part of the card is used. They are valid until the 15th of December of each year before expiring (regardless of how many dives remain on the card).

For courses:

  • A medical certificate stating the individual has no “contra-indications” to diving (not necessary for try dives) less than a year old signed by:

For courses between 0 and 20 metres (Scuba Diver, Open Water Diver and certain specialties) the medical must be delivered by a General Practitioner.

For more Advanced courses or courses that go to a depth greater than 20 metres (Advanced Open Water, Rescue Diver, Dive Master, Instructor and certain specialties) the medical maybe delivered by a General Practitioner.  We strongly recommend that the medical is delivered by a Sport/Hyperbaric or French Diving Federation (or equivalent) approved Doctor.

For children younger than 14 the medical must be delivered by a Sport or Hyperbaric Doctor and for children less than 12 an eardrum test must be conducted by an ear/nose/throat Doctor or any other Doctor having the necessary equipment.

Parental permission for under 18’s.

The reservation of a group booking implies:

  • Paying a minimum 30% deposit of the total price of the trip (transfers, dives, accommodation, lunchtime meals all included).
  • Reservation forms are completed and supplied to Diamond Diving.

From the moment that an order is received Diamond Diving can send a letter refusing the order from any client who is undergoing a legal dispute.
The payment of the balance must be made at the end of the dive course or series of fun dives for individuals, or six weeks before the date of the trip for group reservations.

5.Validity of a course or dive pack

 For all courses:

A booked course is valid for one year from the date of the deposit payment.  After one year, the course or the part of the course, that is not completed cannot be refunded or be part of a claim for a refund.

For dive packs:

Dive packs are valid until the 15th of December of the year concerned.

6.Conditions of courses

6.1. Cancellation or rearranging lessons and or dives:

Due to the complications of last minute cancellations that cause organisational problems Diamond Diving reserves the right to invoice the lesson or dives cancelled less than 72 hours prior or without documented. medical justification.

6.2. Certifying dive or first aid training:

The certification of a dive or first aid course can only be processed when all of the practical and theoretical exercises have been correctly completed.  Diamond Diving reserve the right to withhold certification if the client has not satisfied all of the performance requirements of the course, or if the client has not paid the balance owed.

7.Cancellations

Complying with articles L.121-20 and in respect of the Code of Consumption the client has a delay of seven days to withdraw their request without having to justify the reasons or having to pay any penalties. This seven day delay starts upon receipt of the deposit.  After seven days any cancellation will not result in a refund.

Any diving course that has already started cannot be the subject of refund.  A credit valid for the current year/season for all of the services offered by Diamond Diving (excluding sale of dive equipment or PADI materials) may be given

In the case of a cancellation by the centre Manager due to bad weather or “act of god” a «dive voucher» without time limit will be delivered.  Eventually the client can be refunded if no other solution can be found.

Any client boarding the boat to undertake a dive must pay the price of the dive agreed.

8.Loss, theft or damage of equipment

Any loss, theft or damnage of equipment will result in the immediate invoicing of the non-returned or damaged equipment according to the defined prices (recommended retail prices from Aqualung or Ocean Reef catalogues for the current year).

9.Payments

9.1 Payment methods

Accepted payment methods are cheque (drawn on a French bank account), cash, online payment, brank transfer or ANCV cheques vacances.

To pay online this is done on our website under the menu “Contact/Booking” and the section “Online payment”.  To pay by bank transfer this can only be done in Euros directly payable to Caisse d’Epargne Cote d’Azur:

Any bank charges or commissions will be charged back to the client on the final invoice.

9.2 Non payment

If a payment is not honoured any costs incurred and caused by the lack of payment will be invoiced by Diamond Diving and the order will be automatically cancelled.  The client will be notified by letter.

10.Responsibilities

The client is covered by our “civil responsibility” insurance during dives or lessons run by Diamond Diving.  It is highly recommended that the client has a complementary scuba diving insurance insurance (bodily and material loss).  We advise that you contact DAN Europe to organise this.  DAN Europe: +39 085 893 0333 www.daneurope.org

11.Competent courts or tribunals

The relevant law is French law.  In the case of any difficulty regarding interpretation or application of the current terms and conditions the parties will try whatever possible to resolve the disagreement amicably. In the case of litigation the Commerical Tribunal of Nice is the only competent referee.
